Labor Code Section 4458.2

Compiled May, 2014

Our review of the annotated history reveals the following legislative history (every “c.” below represents a separate legislative bill):

Added: 1961, c. 1581
Amended:
•  1963, c. 1684 to add “or if a person engaged in the performance of active law enforcement service as described in Section 3366 suffers injury or death while in the performance of such active law enforcement service” after “as policeman”
•  1989, c. 892 to rewrite the statute. The statute read, prior to this amendment, as follows:
“If a male member registered as an active police member of any regularly organized volunteer police department as described in Section 3362 suffers injury or death while in the performance of his duty as policeman, or if a person engaged in the performance of active law enforcement service as described in Section 3366 suffers injury or death while in the performance of such active law enforcement service, then, irrespective of his remuneration from this or other employment or from both, his average weekly earnings for the purposes of determining temporary disability indemnity and permanent disability indemnity shall be taken at the maximum fixed for each, respectively, in Section 4453. Four times his average annual earnings in disability cases and in death cases shall be taken at the maximum limits provided in Sections 4452 and 4702 respectively.”

Tracing Statutory Language:

  • Research fees can be minimized by ordering only the bills that affected specific subdivisions or phrases of interest to you.
  • Changes to statutes can sometimes be determined by the annotations provided by Deering’s, Westlaw, and Lexis.
  • If annotations are not available, one strategy is to look at each chaptered law noted above to observe the changes. Another strategy is to retain us to trace your language and report our findings back to you.
